INSTRUCTIONS FOR COMPLETING THE
ANNUAL LAW ENFORCEMENT AGENCY REPORT
TO THE ATTORNEY GENERAL'S OFFICE
Question 1 - Total number of traffic stops: This will reflect the total number of vehicles stopped by officers in your agency for alleged motor vehicle violations, whether moving violations, equipment violations, or license violations for the period from August 28, 2000 (the effective date of the law) to December 31, 2000. This total would not include vehicle stops made for reasons other than alleged motor vehicle violations.
Question 2 - Traffic violation(s) resulting in stop: For all stops made, indicate the number of stops resulting from: 1) Moving violations; and/or 2) Equipment violations; and/or 3) License violations.
Question 3 - Categories of "Moving" violations: For all instances where a "moving" violation resulted in the stop, indicate the category of violation or violations. Use "Other" when the categories given do not cover the violation.
Question 4 - Result(s) of traffic stops: For all stops made, indicate: 1) the number of stops resulting in citations; 2) the number of stops resulting in warnings; and 3) the number of stops resulting in arrests. For this question, do not include arrests made as a result of a search. This information is included in Question 14.
Question 5 - Race/minority status of drivers stopped: For all stops made during this period, indicate the number of drivers stopped in each of the following NCIC categories: 1) White; 2) Black/African-American; 3) Hispanic/Latino; 4) American Indian/Alaska Native; 5) Asian; or 6) Other/Unknown.
Question 6 - Age of drivers stopped: For all stops made, indicate the number of drivers stopped in each of the following age groups: 1) Under 18; 2) 18-29; 3) 30-39; 4) 40 or above.
Question 7 - Gender of drivers stopped: For all stops made, indicate the number of drivers stopped in each of the following categories: 1) Male; 2) Female.
Question 8 - Location of traffic stops: For all stops made, indicate the number of stops made at each of the following locations: 1) Interstate highway; 2) U.S. highway; 3) State highway; 4) County Road; 5) City Street; 6) Other. For purposes of this question, the location means the location where the officer observed the alleged violation and signaled the driver to stop, not the location where the driver actually did stop.
Question 9 - Traffic stops resulting in searches: For all stops made, indicate the total number of searches made, along with the following: 1) number of searches of drivers; and 2) number of searches of property. One stop may lead to a search of the driver and property (whether the vehicle itself or property inside the vehicle) so the breakout of the searches may exceed the number of stops resulting in searches.
Question 10 - Probable cause/authority for search: For all searches made, indicate the number of searches where the basis for those searches was: 1) consent; 2) inventory; 3) odor of drugs or alcohol; 4) incident to arrest; 5) plain view contraband; 6) reasonable suspicion that the individual may possess a weapon ("Terry Stop"); 7) drug dog alert or 8) other. For any search, one or more of these categories may apply. Example: the basis for a search may include the odor of drugs and a drug dog alert.
Question 11 - Duration of search: For all searches made, indicate the number of searches lasting: 1) from 0 to 15 minutes; 2) from 16 to 30 minutes; 3) 31 minutes or longer. The duration of a particular search means the amount of time needed to conduct any and all searches described in Question 9.
Question 12 - Traffic stops leading to discovery of contraband: For all searches made, indicate: the number of traffic stops in which contraband was discovered.
Question 13 - Type of contraband discovered: Indicate the number of times each of the following types of contraband were discovered: a) Illegal drugs/Drug paraphernalia; b) Currency; c) Weapons; d) Stolen property; or e) Other.
Question 14 - Total number of drivers arrested as a result of search: For all searches, indicate the number of arrests made. The number of arrests made pursuant to searches does not include the number of arrests made pursuant to stops (see Question 4).
Question 15 - Crime/violation alleged as a result of arrests: For all arrests made (add totals for Question 4 and Question 14), indicate the number of times each of the following crimes or violations were alleged: 1) Outstanding warrant; 2) Drug violation; 3) Resisting arrest; 4) Property crime; 5) Offense against person; 6) DWI/BAC; or 7) Other. For this question, each arrest may result in more than one alleged crime/violation.
Pages 2-7 - Breakdown of Annual Report by Race/Minority Status: These attachments provide the same information as the total stop report but broken down for each of the following race/minority groups: 1) White; 2) Black/African-American; 3) Hispanic/Latino; 4) American Indian/Alaska Native; 5) Asian; and 6) Other/Unknown.
The total number of stops for pages 2-7 should equal the total of number of traffic stops reported by the agency on page 1 of the report.
